Fact Summary:

Summarize the facts of the case by emphasizing the important details only. DO NOT just rewrite the facts. I will be looking to see if you can identify the key components of the case that must be brought to a judge’s attention as pertinent to addressing the matter.

1. Fact Issues/Law Issues: Provide a list of issues, both fact and law. What questions, when answered, will clarify your client’s story better? You may require more background information or more details on the day that the event in question took place. These are fact questions and potential issues. Next, explore the law. Start with general questions that may help identify which law applies.
2. Secondary Sources: Find at least one secondary source that assists you in better understanding your case. Remember, secondary sources lead you to primary sources. You may find a news article, textbook chapter or CED summary. You might find a journal article or dictionary definition that can shed some light on your legal topic. Provide a screenshot of your findings to establish where you found it. Read it, summarize it and comment on what you have learned through it. Point out which issues, if any, from Question 2 above were answered through this secondary source.
3. Primary Sources / Applicable Law: Find a primary source. What law(s) apply to your case? Look for cases, statutes, and doctrines. Familiarize yourself with the law and apply it specifically to your case. If it is a statutory law, which section and subsection specifically apply? If it is a doctrine, which components or elements of the doctrine apply? Summarize your findings by creating a Legal Brief. See a sample brief provided.
