Students are asked to consider the following:- 

Claire has been working for a specialist financial recruitment agency called Hirem for four years. She has become very experienced and has direct contact with a wide range of clients. The agency has a high labour turnover and Claire is in fact their longest-serving recruitment consultant.

Rob, another recruitment consultant, commenced working for the agency 9 months ago and has been getting on really well with colleagues and clients. Rob was taken on for his extensive digital marketing and social media expertise and he has already succeeded in developing many connections on his LinkedIn account. His contract includes a 12 month probationary period.

Claire and Rob’s contracts of employment both contain a clause prohibiting them from working for, managing, owning or part-owning a recruitment agency within the Republic of Ireland, or from soliciting any clients or employees of Hirem. This prohibition applies both during during the term of their employment with the agency and for a period of two years after the termination of employment.

Claire and Rob have been having a secret affair, and plan to leave Hirem to set up a rival recruitment agency. Liam, the agency owner has heard rumours about their plans. Liam fears that many clients will follow Claire and Rob if they open a similar agency in the area.

Liam wishes to protect the goodwill of his business and approaches you for advice on the following:

  1. Any course of action he, as their employer, can take against Claire and Rob, including the issue of any possible settlement of the matter, and
  2. Any practical steps he should take to avoid and/or protect his business against this type of dispute in the future.
